CHINA TRADEMARK REGISTRATION

Introduction

Enlisting or registering your own trademark means that you have the sole and exclusionary rights to use the trademark in relation to the goods and services for which the mark is registered.

We provide assistance on investigating this and do provide advisory on if your potential trademark is distinctive from others, a graphic representation of your trademark and also lodging your application with the China Trademark Office. Additionally, we will investigate which class your establishment falls under. In China, each type of operation is specifically classified under 1 to 45 categories which have to be clearly specified during registration process.

Fees and Procedures

We will submit your application to the Trademark Office of China.  After the formality examination of the Trademark Office, your application will be accepted by the Office, and a Notification of Acceptance will be delivered. Usually, the stage of formality examination will take about 3 to 4 months. The accepted trademark will be filed in the Trademark Office, wait for the substantive examination. Usually, the stage of substantive examination will take about 24 months. After the substantive examination if your trademark turns out to be registrable, the trademark will be published by the Trademark Office. After the 3-month publication stage – if no one files an opposition against this trademark, the Registration Certificate will be delivered.  A-Swiss through our lawyer will be of assistance to facilitate a follow up in writing to the registry. The entire integrated application procedure would take around 24 months from receipt of application of registration if no queries arise. The period of validity of the trademark is 10 years from the date of filing the application.

Fees for 1 word or 1 logo

  • Search fee to the Trademark Registry: around USD125+
  • Registration lodgment: 10 products or service items within one class : around USD1,950+
  • The fee for each additional class is between USD650 to USD750
  • Additional products or service items: around USD50
  • Correspondences with the Trademark Registry by a lawyer(if required): Time charges

Information Required

Please provide us with the following information:

  • The proposed trademark logo and words which indicating the nature of the trademark (sound, smell, color etc);
  • A list of the goods and services which are being provided/supplied under the trademark; and
  • Certificate of Incorporation of the company;
  • Instruction letter, stating the name and address of the assignee, preferably with Chinese versions;
  • Power of Attorney, executed by the assignee.
  • Where the designated goods of the assigned trademark registration is for medicine for human use, baby foods, or dieteti products for medical use, copies of assignee’s manufacture and sales licenses shall be submitted.
